Terms of Service

Effective November 19, 2025. Please review these Terms carefully. By signing in, purchasing credits, or accessing the Gener8AI dashboard you agree to be bound by this agreement.

1. About Gener8AI

Gener8AI is an AI-powered creative workspace for prompt enhancement, image generation, gallery management, upscaling, and workflow guidance. These Terms of Service (“Terms”) form a binding agreement between you and Gener8AI regarding your access to and use of the platform, dashboard, APIs, and related mobile or web experiences.

By signing in with Google, purchasing credits, or continuing to use the product you acknowledge that you have read, understood, and agree to be bound by these Terms and all referenced policies.

2. Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a legally binding contract.
  • Account access currently occurs through Google Authentication. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
  • We may refuse service, disable accounts, or reclaim usernames if needed to protect the platform.

3. Credits, Plans, and Billing

  • Credits meter usage for generations, prompt enhancements, and upscales. Each plan lists its included credit allotment and per-feature cost.
  • All credits (purchased through subscription plans, one-time purchases, or promotional offers) remain in your account until used and never expire.
  • Paid plans renew according to the cadence shown during checkout. We use PayPal to process subscriptions and do not store full payment information.
  • Upgrading a plan through the dashboard immediately activates the new PayPal subscription and cancels the prior one; any unused time from the previous plan is not prorated or refunded.
  • Downgrading or canceling a plan takes effect at the end of the current billing cycle. You must keep your PayPal agreement in good standing, and you may also cancel directly in PayPal if required.
  • One-time credit purchases are processed via PayPal, are delivered instantly to your account, and are non-refundable except where required by law.
  • All credits are non-transferable and have no cash value.

4. Generated & Uploaded Content

Prompts you submit and images you upload: Reference images, source materials, and prompts you provide must be properly licensed or owned by you. By submitting content, you grant Gener8AI the broad license described below.

AI-generated outputs: Ownership and copyright status of AI-generated content is subject to applicable law and the terms of the underlying AI service providers (Replicate, Google Cloud, Vertex AI, etc.). You are granted the right to use, modify, and distribute outputs you generate, subject to these Terms and third-party service terms. Gener8AI makes no warranties regarding ownership, originality, or copyright status of AI-generated outputs.

You grant Gener8AI a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your prompts, uploads, and outputs in any form or medium, for any purpose, including but not limited to operating the service, training AI models, research and development, marketing, and improving our products.

You are solely responsible for the legality, reliability, and appropriateness of any content you submit or generate, including ensuring compliance with third-party AI service terms and applicable intellectual property laws.

5. Acceptable Use & Safety

  • Do not use Gener8AI to create, upload, or distribute content that is illegal, exploitative, hateful, harassing, violent, pornographic, or otherwise violates any law or regulation.
  • Strictly prohibited content includes depictions of minors, self-harm instructions, doxxing, malware, spam, and material that infringes intellectual property or privacy rights.
  • Outputs may contain artifacts or errors. You are responsible for reviewing all outputs before use and for complying with applicable disclosure requirements when publishing AI-generated media.
  • We reserve the right to remove content or suspend access when we believe a user has violated these Terms, applicable law, or partner policies.

6. Third-Party Services

Core features rely on services provided by Firebase, Google Cloud, Replicate, Vertex AI/Gemini, PayPal, and other infrastructure partners. Your use of those features is also subject to the third-party terms governing those services. Gener8AI is not responsible for outages or issues originating from those partners but will make commercially reasonable efforts to provide status updates and workarounds.

7. Privacy & Security

We collect and store account information, prompts, generated images, and usage metrics to provide and improve the platform. Please review our Privacy Notice for details on how data is handled, how long it is retained, and what choices you have.

You agree that we may process and store your data in the United States or any other country in which we or our service providers operate.

8. Termination

You may stop using Gener8AI at any time. We may suspend or terminate access with or without notice if you violate these Terms, fail to pay applicable fees, attempt to compromise the service, or cause legal liability for Gener8AI.

Upon termination, your license to use the platform ends and we may delete or restrict access to your content, subject to applicable law.

9. Disclaimers & Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. GENER8AI DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENER8AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Updates

We may modify these Terms from time to time. Material changes will be communicated through the product or by email. Continued use of Gener8AI after changes become effective constitutes acceptance of the revised Terms.
